Judge’s Gag Ruling ‘Will Finally Lead to Her Removal’ in Documents Case, Legal Expert Predicts
Cannon repeatedly has been rebuked by appeals court
A decision by the federal judge overseeing Donald Trump’s classified documents case to rejected special counsel Jack Smith’s request for a gag order against the former president is the “smoking gun” that will get her removed from the case, according to a prominent legal scholar.
Federal Judge Aileen Cannon on Tuesday denied Smith’s request which came after Trump repeatedly and misleadingly criticized the FBI for having a policy in place around the use of deadly force during the search and seizure of government records at his resort in August 2022.
Trump is accused of illegally taking boxes of federal documents with him when he left the White House and then obstructing the government’s ability to retrieve those records.
Cannon, who was appointed to the federal bench by Trump, has long been accused of improperly favoring him in this case.
She has resisted efforts even to set a definite date for trial, and twice her rulings in the case have been overturned by a federal appeals court in very strong terms.
Although she has continued to remain on the case, this most recent decision will lead to her removal, according to prominent attorney and legal scholar Laurence Tribe.
“Cannon’s wildly lawless rejection of Special Counsel Smith’s clearly correct request for a gag order against fake and dangerous claims that the FBI was ordered to assassinate him is good news. It’s the smoking gun that will finally lead to her removal from the stolen secrets case,” Tribe, who taught at Harvard Law School before his retirement, posted to social media.
