Republican Governor Latest to Encourage Texas To Ignore US Supreme Court Ruling
Biden could federalize National Guard to enforce court’s decision
Add the governor of South Dakota to a growing list of Republican politicians actually advocating for the abandonment of the rule of law in the United States.
Well more than a dozen governors and others are actively calling for Texas Republican Gov Greg Abbott to defy the US Supreme Court and continue to maintain barriers illegally along the southern border.
A 5-4 Supreme Court decision Monday allows the federal government to remove razor wire on the border wall placed by Texas law enforcement. The government argued the wire illegally prevented them from managing the border.
The conflict escalated earlier this month when the Texas National Guard and the Texas Department of Public Safety erected fences and razor wire in Eagle Pass, Texas, a popular spot for migrants to cross into the United States.
Texas law enforcement prevents U.S. Border Patrol from accessing the area, which Border Patrol said prevented them from saving the life of a mother and two children who drowned in the Rio Grande.
“Governor Abbott has done the exact right thing, and I’ll drive him more razor wire from South Dakota if I have to for him to do his job,” South Dakota Gov Kristi Noem said, pouring gasoline on the issue in an on-camera interview with Fox News.
These moves by Noem and other Republicans to walk away from the rule of law would seem to be ratcheting up tensions as President Biden will have to decide how to respond and potentially enforce the high court’s ruling. That could involve the president federalizing control of the the National Guard in Texas, relieving Abbott of that authority.
“This is a powder keg worth of tension,” Oklahoma’s Republican governor, Kevin Stitt, said on the right-wing cable network, Newsmax. “So it’s a very weird situation.”
Stitt added: “We certainly stand with Texas on the right to defend themselves, but Biden’s gonna be in a tough situation, so in other words, he’s going to try to federalize these troops.
“In other words, put them on federal orders, and so now their allegiance technically goes to the president of the United States instead of the governor, and of course I think a lot of Texans– these are still– they’re still Texans that are weekend, you know they’re in the National Guard, they do one weekend a month or when they get called up on duties by the governor, and I think they would be in a difficult situation to protect their homeland or to follow what Biden’s saying. I think it will be very interesting.”
