WASHINGTON WATCH: Investigate and Prosecute The 'Roe 5' NOW
The justices behind the Alito draft should absolutely be pursued for perjury
Justice Samuel Alito and the four other right-wing justices who have apparently signed onto the draft decision to strike down the national right to abortion should be, henceforth, known as the “Roe 5.”
Signs were beginning to abound pointing to the absolute partisan corruption of the highest court in the land. But that these justices are now ready to overturn Roe v Wade, the decision which has — for almost a full 50 years — guaranteed women legal access to abortion services nationally must be seen as a bridge too far.
Each one is guilty, on a prima facie basis, of perjury. Plain and simple.
A clearly — and rightfully — livid Sen Kirsten Gillibrand (D-NY) got down to that point this week during a Senate press conference.
“It is an outrage that we have five justices on the Supreme Court who lied — lied — in their confirmation hearings, in order to be confirmed,” she said. “It is an outrage that, in America today, that our judicial system is so corrupted and so politicized, and no longer representative of the will of the people.
“Five justices said that they respect precedent. Five said that Roe v Wade is [an] established precedent. Five said that they would never undermine established precedent. It is unconscionable what this decision will do to the American people.”
Those five justices are dead-to-rights in how guilty each is of having committed perjury by lying to Congress in their respective confirmation hearings.
The press has been very helpful this week, in running tape for each one — including Alito — genuflecting for “settled law.”
These statements have been carried repeatedly by the news.
And Gillibrand is absolutely correct when she said that abortion rights and basic civil liberties will be on the ballot this year.
Democrats across the country ought to prosecute that political case hard, in the run-up to the midterm elections in November.
But there really is another case here, which must be prosecuted: That of at least one count each of perjury and lying to Congress.
The Senate Judiciary Committee has an absolute obligation to open an investigation, and then, yes, it will be a national spectacle unprecedented in history — but it will absolutely required — for the committee to forward criminal referrals for each justice to the federal Justice Department for prosecution.
Would Justice, and Attorney General Merrick Garland follow through and actually prosecute?
Maybe not.
But, in the meantime, Democrats must go “scorched Earth,” and be willing to taint each justice, ruin their reputations and their personal comfort.
They must be made to go through indignities commensurate and equivalent to what they will be asking women to endure as a result of this — yes, corrupt and criminally arrived-at — decision.
We women of America deserve no less.
We have seen the tactics that Republicans will employ — and the extreme lengths that they go to — to get what they want.
It's past time for Democrats to do likewise.
